JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 1115/2012, registered for offences punishable under Sections 323, 409, 406, 420, 421, 462, 465, 469 and 504 of the Indian Penal Code.
Allegation as per complaint petition is that complainant was working for the Milk Production Cooperative Society Vikramshila, on 25.05.2012, the petitioner and one other without giving any notice framed another company in order to grab the money of the complainant for supply of 85 kg of milk at the rate of Rs 17/- per kg although Rs. 10,000/- was credited in the bank account but the chairman of the company did not pay a single farthing rather on demand of his money, complainant was abused
Patna High Court Cr.Misc. No.28139 of 2018 (3) dt.13-07-2018 2/2 and Rs. 2,000/- is due with the petitioner.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case, moreover, he is ready to pay the above stated amount of Rs. 2,000/- to the complainant. Heard learned APP as well as learned counsel for the complainant.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below along with a demand draft of Rs. 2,000/- drawn in favour of the complainant and the court below after verifying the same, shall release the petitioner on bail to his own satisfaction on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount subject to the condition as mentioned under Section 438 (2) of the Cr.P.C.
