Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Jandaha P.S. Case No. 137 of 2021, registered for the offences punishable under Sections 143, 447, 341, 323, 325, 504, 506, 354 & 379 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation, the accused persons came to the house of the informant and the specific allegation against the petitioner is that he assaulted the informant with lathi on his head which hit his left hand and he sustained fracture injuries. Learned counsel for the petitioner has submitted that the petitioner and the informant are own brothers. There is case and
Patna High Court CR. MISC. No.67998 of 2021(2) dt.25-07-2022 2/2 counter case and Renu Devi, the wife of the petitioner has lodged a case against the informant and his family members. The members of defense side have assaulted the wife of the petitioner after breaking the door of the house. The petitioner is a person of clean antecedent. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali in connection with Jandaha P.S. Case No. 137 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
