JUSTICE MUNGESHWAR SAHOO ORAL ORDER 22-04-2016 Perused the order passed by the Court below dated 20.03.2015. It appears that the Sub Judge I, Sasaram, Rohtas has allowed the amendment application filed by the plaintiffrespondent in Title Suit No.264 of 2013. It further appears that only issues have been framed, therefore, it is a pre-trial amendment.

In such view of the matter, it cannot be said that the amendment sought for prejudiced the petitioner in any way nor it occasioned failure of justice.

The learned counsel, Mr. Rajeev Shekhar, A.C. to G.P.24 admitted the fact that the State of Bihar had not filed any objection to the amendment application.

In view of the above position, since by the order only amendment has been allowed, I find no reason to interfere with the

Patna High Court CWJC No.9688 of 2015 (2) dt.22-04-2016 impugned order.

Thus, this writ application is dismissed.
