JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-09-2019 The petitioners apprehend their arrest in connection with Narpatganj P. S. Case No. 186 of 2019 registered under Sections 323, 354B, 341, 379, 427 and 504/34 of the Indian Penal Code. Allegation against the petitioners is that no sooner than the informant's brother reached near his home, petitioners and others surrounded the informant and assaulted him and snatched a sum of Rs. 2200/- from the informant's pocket and petitioner

Patna High Court CR. MISC. No.56532 of 2019(2) dt.05-09-2019 2/3 no. 8 Nikesh Das, petitioner no. 2 and petitioner no. 1 Buddachand Das tore the cloth of three sisters of the informant and also assaulted them.

Learned counsel appearing on behalf of the petitioners submits that both parties are co-villagers and there is groupism in between them. He further submits that there is land dispute between the parties and also there is case and counter case in between them inasmuch as Narpatganj (Basmatiya) P.S.Case No. 185 of 2019 has been lodged by petitioner no. 4 against the informant and others and Narpatganj (Basmatiya) P.S.Case No. 187 of 2019 has been lodged by the sister of the informant against these petitioners and others.

After having heard learned counsel for the parties and taking into consideration the fact that there is case and counter case in between the parties and they are co-villagers having land dispute between them, as such I am inclined to grant anticipatory bail to the petitioners.

Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned
