JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-01-2016 The petitioner was appointed as a peon in R.K.C. High School, Phulwaria, Begusarai on the recommendation of District Education Officer vide letter no. 166 dated 01.09.1994 issued by the RDD, Darbhanga Pramandal, Darbhanga. It appears that besides the petitioner, a number of employees were appointed in the similar manner and their services were regularized. After a lapse of 10 years, the services of the petitioner has been terminated vide order dated 27.06.2000. The petitioner submits that many such employees, who were appointed in similar manner, were also terminated from service by the same impugned order.
They challenged the termination order which was allowed. The petitioner has annexed a number of such orders in this writ application.
Patna High Court CWJC No.12235 of 2014 (2) dt.19-01-2015 2/2 were terminated, have been reinstated pursuant to the order of this Court.
I find the petitioner has already filed representation (Annexure-7) praying for similar treatment, also in view of Bihar State Litigation Policy, 2011.
The writ application is disposed of with an observation that respondent no. 2 would consider his representation within four months from the date of receipt of copy of this order. It goes without saying that if the case of petitioner is similar, then he too ought to be accorded similar benefits. (Samarendra Pratap Singh, J) kunal/rohitU
