JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 In the present application, the petitioner has sought modification of the order dated 11.08.2014 passed in Cr. Misc. No.21897 of 2014. It would be relevant to state here that on the submissions made on behalf of the petitioner that Jitendra Yadav is the tenant of the petitioner, taking into that account, the petitioner was granted anticipatory bail by the aforesaid order. It has been submitted that the said Jitendra Yadav has refused to appear before the court below and hence present application for modification has been filed. The aforesaid order has been passed on the concession offered by the petitioner and it would not be possible for this Court to modify the order dated 11.08.2014. Hence, in the circumstances, the present application is dismissed with a direction that the petitioner shall appear before the court

Patna High Court Cr.Misc. No.30036 of 2015 (2) dt.21-07-2015 2/2 below within a period of four weeks and seek regular bail. The court below shall consider the case of the petitioner without being prejudiced by this order.
