JUSTICE MIHIR KUMAR JHA ORAL ORDER 14-01-2015 Having heard learned counsel for the parties as with regard to the allegation made against the petitioner for offence under Sections 420, 467 and 468 of the Indian Penal Code, this Court, in view of the finding arrived at by the Sessions Judge, Gaya in his reasoned order, is not inclined to grant anticipatory bail to the petitioner only because she is lady. The petitioner, on her own showing being the Acting Headmistress, had the responsibility for maintaining the correct record in respect of number of students in the school that was found to be inflated, as also substantiated by the police in course of investigation as per the findings recorded in the impugned order of the Sessions Judge, Gaya.
That being so, while prayer of anticipatory bail of the
Patna High Court Cr.Misc. No.30220 of 2014 (2) dt.14-01-2015 2/2 petitioner is hereby rejected, nothing said in this order shall come in the way of the petitioner to avail the observation, already made by the Sessions Judge in the impugned order for the purposes of consideration of grant of regular bail to her.
