JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-07-2017 Heard learned Counsel for the parties concerned. A show cause reply has been filed on behalf of Opposite Party No. 2, wherein it has been stated that in compliance of this Court's order, dated 20.06.2014, passed in CWJC No. 23322 of 2012, the petitioner's service for the period 20.06.1988 to 31.01.1992 has been regularized and treated to be on duty. It has been stated in the said show cause reply that payment arising out of the said decision taken in pursuance of this Court's order shall be made within four weeks from today.
In view of the fact that the State Government has already decided to treat the said period on duty and they intend to pay
Patna High Court MJC No.2903 of 2016() dt.19-07-2017 2/2 the salary as a consequence of the said decision, in my opinion, no case of deliberate disobedience of this Court's order is made out.
This application is disposed of with an observation that the opposite parties must strictly adhere to the time frame, as suggested by them in the payment of the salary for the said period.
