The petitioners apprehend their arrest in connection with Bidupur P. S. Case No. 37 of 2017 instituted under Sections 323, 325, 341, 379, 447 and 504/34 of the Indian Penal Code. The allegation, in brief, is that the petitioners entered into the house of the informant and assaulted with iron rod causing fractured in her left hand and also got removed cloth from her body and Pinki Devi snatched away golden nose pin. Learned counsel for the petitioners submits that the petitioner no. 1 is the brother of the husband of the informant and they are co-sharers and the petitioner no. 2 is the wife of the petitioner no. 1 and they have been falsely implicated in the case due to family dispute and falsity of the case is also apparent from
Patna High Court Cr.Misc. No.20638 of 2017 (2) dt.12-06-2017 2/2 the fact that this case was lodged after lapse of approximately a month and these two petitioners have no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioners, namely, Vikash Sah and Pinki Devi, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S.Case No. 37 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
