====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 29-08-2025 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable u/s 148, 149, 448, 341, 323, 326, 307, 302 and 427 of the Indian Penal Code and Section 27 of the Arms Act.
3. The allegation in the first information report is upon nine accused persons that they came variously armed to the house of the informant and gave knife blows to the father of the informant, namely, Rajendra Rai who was declared dead in course of his treatment. There is further allegation that others were also assaulted by various arms.
4. Learned counsel for the petitioner submits that the first

No.58346 of 2025(2) dt.29-08-2025 2/3 information report would clearly show that there are general and omnibus allegations of giving knife blows to the deceased Rajendra Rai and so far as allegation of firing is concerned, the same is also general and omnibus in nature. However, subsequently during the course of investigation, it has transpired that it was this petitioner who had given a gun shot injury to Mithun Rai and the injury report would show that he had received a gun shot injury on the left side of chest which was said to be grievous in nature. It has further been submitted that there is case and counter case between the parties and the persons of the side of the petitioner have also received injuries. Further the petitioner is languishing in custody since 13.01.2025 and the petitioner has renewed his prayer for bail on account of the liberty given by way of the order dated 22.05.2025 to renew the same after framing of charges, as the charges against the petitioner has been framed on 18.07.2025 (Annexure-3).
5. Learned APP for the State has opposed the prayer for bail on account of the serious nature of injury.
6. Considering the facts and circumstances and also in view of the liberty earlier granted and considering that the charges has been framed in this case, let the petitioner abovenamed, who is in custody since 13.01.2025, be enlarged on bail on furnishing
Patna High Court CR. MISC. No.58346 of 2025(2) dt.29-08-2025 3/3 bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Triveniganj P.S. Case No. 577 of 2022, subject to the conditions that the petitioner shall cooperate in the trial and would remain physically present on each and every date, failing which on account of no substantial reasons on two consecutive dates, the learned court below shall have liberty to cancel the bail bonds.
