Petitioners apprehend their arrest in connection with Dhamdaha P.S. Case No. 326 of 2015, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 326A, 379 and 504 of the Indian Penal Code.

Allegation against the petitioners is that they have assaulted and threw acid on the informant and other persons. Submission of learned counsel for the petitioners is that petitioners Nos. 1, 3 and 4 are concerned, there is no allegation of assault against them and allegation against petitioner No.2 is that he sprinkled acid on the informant and other family members. However, after investigation police has not found case true against

Patna High Court Cr.Misc. No.27333 of 2018 (3) dt.11-05-2018 2/2 the petitioners and charge sheet has been submitted against Ganesh Poddar and Krishna Poddar and cognizance has been taken.

Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioners.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, above named, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Dhamdaha P.S. Case No. 326 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of court concerned.
