The petitioner apprehends his arrest in connection with Maharajganj P. S. Case No. 52 of 2017 instituted under Section 379 of the Indian Penal Code.
The allegation, in brief, is that motorcycle of the informant was stolen by some unknown persons. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and there is no material against him except disclosure of his name regarding giving master key to other co-accused. He submits that there is no recovery of the motorcycle from the possession of the petitioner rather the same recovered from one Rahul Yadav and this petitioner has no criminal antecedent, except one case later on instituted after the
Patna High Court Cr.Misc. No.30145 of 2017 (2) dt.06-07-2017 2/2 present case regarding recovery of the motorcycle of the present case.
Having considered the aforesaid facts and circumstances, let the petitioner, namely, Manoranjan Rai, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5th, Siwan in connection with Maharajganj P.S.Case No. 52 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
