ANJANA MISHRA ORAL ORDER (Per: HONOURABLE THE ACTING CHIEF JUSTICE ) 01-04-2016 Heard Mr. Sanjay Kumar, learned Counsel, appearing on behalf of the petitioner, and Mr. Ashok Kumar Keshari, learned Assistant Counsel to Additional Advocate General No.11, appearing on behalf of the State. By way of this application, under Article 226 of the Constitution of India, in the form of a Public Interest Litigation, the grievance expressed by the petitioner is that at Primary Sub Health Centre at Senduari Block no appointments are being made of the medical staff and technical staff, including Auxiliary Nurse Midwife.

By filing the counter affidavit, the respondents have contended that there are two sanctioned posts of Auxiliary Nurse Midwife at Primary Sub Health Centre at Senduari Block

Patna High Court CWJC No.10525 of 2015 (2) dt.01-04-2016 2/2 and both the posts have been filled up on contractual basis and persons so appointed are working.

In view of the above and in the interest of justice, while closing the application we direct the respondents concerned to expedite the process of making permanent appointment on the posts, aforementioned, with liberty granted to the petitioner to approach this Court with appropriate application, in future, if so advised, and also to take recourse to such provisions of law as may be permissible, if situation so warrants.
