This application, for grant of anticipatory bail, arises out of Panapur Police Station Case No. 27 of 2017, disclosing offences under Sections 147, 148, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against these petitioners and no specific overt act is attributed to them. In fact, the petitioners and the informant happen to be agnates and there is land dispute between the parties and on account of that altercation took place between the parties in which informant and his family members sustained injuries, which are simple in nature. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of these petitioners and submitted that there is direct allegation of assault by giving farsa blow causing injury on the head of the informant against petitioner no.1 and petitioner no.2 is said to have gave sword blow causing injury on the head of the father of the informant.
Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of these petitioners is rejected.
