JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-06-2017 Heard the learned counsel for the petitioners and the learned Additional P.P. for the State.
The petitioners seek anticipatory bail in connection with Risiup P.S. Case No. 09 of 2017, registered for the offence punishable under Sections 379, 411, 420/34 of the Indian Penal Code.
The allegation against the petitioners is with regard to plying over loaded truck from Hariharganj side, causing damage to the roads.
The learned counsel for the petitioners has submitted that the petitioners are the owners of the truck. The learned
Patna High Court Cr.Misc. No.23487 of 2017 (2) dt.13-06-2017 2/2 counsel for the petitioners has further submitted that similarly situated co-accused have been granted bail by an order dated 22.03.2017 passed in Cr. Misc. No. 11538 of 2017. Having regard to the facts and circumstances of the case and particularly the fact that the case of the petitioners is similar to that of other accused persons who have been granted bail by this Court, as aforesaid, I deem it fit and appropriate to grant anticipatory bail to the petitioners.
Accordingly, in the event of their arrest or surrender in the Court below within a period of four weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 20,000/- each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, Aurangabad (Bihar), in connection with Risiup P.S. Case No. 09 of 2017, subject to the conditions laid down under Section 438(2) Cr. P. C.
