JUSTICE ARUN KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Charpokhari P.S. Case No.134 of 2016, arising out of Complaint Case No.414(C) of 2016 registered under Sections 420, 409, 467 and 471 of the Indian Penal Code.
Allegation is that the petitioner retired from the post of Headmaster of a primary school and he submitted a forged charge report as well as No Objection Certificate though no charge was handed over to the complainant.
Learned counsel for the petitioner submits that the petitioner after retirement handed over charge to the senior most teacher Shanti Devi on orders of the Block Education Officer and
Patna High Court Cr.Misc. No.29152 of 2017 (2) dt.13-07-2017 2 / 2 this case is not lodged by any authority rather by the teacher of that school due to personal grudge and the petitioner after retirement is getting his regular pension and has also received all retiral benefits.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Bhojpur in connection with Charpokhari P.S. Case No.134 of 2016, arising out of Complaint Case No.414(C) of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Arun Kumar, J.) S.Kumar/- U T
