Petitioner apprehends arrest in connection with Bypass P.S. Case No. 34 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner and the informant are agnates and there is admitted land dispute between them. There is case and counter case between the parties. There is no injury on the record to substantiate the allegations levelled under section 307 I.P.C. the allegations levelled under section 379 I.P.C. are ornamental. Case No. 34 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
