JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2018 The petitioner is apprehending his arrest in connection with Bisfi (Patauna) P.S. Case No. 80/15, registered for offences punishable under Section 135 of the Bihar Vidhut Adhiniyam. Allegation against the petitioner is of commission of theft of electricity causing revenue loss of Rs. 1,25,112/- to the Government.

It has been submitted on behalf of the petitioner that due to technical problem, such a huge amount of electricity bill has been given to the petitioner and petitioner has also requested for correction in the bill but till date no correction has been made. However, after some argument, learned counsel for the petitioner agreed that petitioner is ready to deposit 50% of the said amount which is Rs. 62,556/- if some reasonable time is allowed. Heard learned A.P.P. as well as learned counsel appearing on behalf of North Bihar Power Distribution Company

Having heard both sides, considering the facts and circumstances of the case, let petitioner surrender before the court below within a period of four weeks along with a demand draft of Rs. 31, 278/- ( Rs. Thirty One Thousand and Two Hundred Seventy Eight) payable to NBPDCL and the court below after satisfying himself release the petitioner on provisional bail to his own satisfaction for a period of two months, during which period the petitioner shall deposit the rest of amount i.e. 31,278/ -( Rs. Thirty One Thousand and Two Hundred Seventy Eight) and after deposit of complete amount i.e. Rs. 62,556 ( Rs. Sixty Two Thousand Five Hundred Fifty Six), the court below shall confirm the provisional bail of the petitioner and if the petitioner fails to deposit the above stated amount, the court below shall cancel the provisional bail of the petitioner.
