JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-06-2017 Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Patori (Mohanpur O.P.) P.S. Case No. 392 of 2016 registered for the offences under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
As per prosecution case, the petitioner is said to have fired upon the informant but it missed while the father of the petitioner Mahesh Rai stabbed the informant by means of knife. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence and he has falsely been implicated in the case. It is counter blast of Complaint Case No. 1537 of 2016 filed by the mother of the
Patna High Court Cr.Misc. No.19187 of 2017 (2) dt.13-06-2017 2/2 petitioner against the informant and others. No fire arm injury has been inflicted to the informant. Co-accused Mahesh Rai has been enlarged on bail by this Court vide order dated 20.02.2017 passed in Cr. Misc. No. 6416 of 2017.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Samastipur in connection with Patori (Mohanpur O.P.) P.S. Case No. 392 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
