This application for anticipatory bail arises out of Gogri P.S. Case No. 171 of 2019 for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 353, 337, 338, 504

Patna High Court CR. MISC. No.55783 of 2019(2) dt.04-09-2019 2/3 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

There are 26 persons named in the First Information Report including these petitioners. From the First Information Report, it appears that there was an altercation between two groups of persons, one led by the petitioner No.1 and the other by co-accused Arun Yadav. Allegedly, they hurled abuses on each other and started opening fires. Despite intervention of the police, they kept on firing. It is also alleged that even female members of the group, supporting petitioner No.1, indulged in the commission of offence by brick batting and rioting.

Learned counsel appearing on behalf of the petitioners has submitted that it is evident from the First Information Report that the petitioners were objecting to use of a Government land by co-accused Arun Yadav for private purpose.

Considering the facts and circumstances, this application is allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.55783 of 2019(2) dt.04-09-2019 3/3 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, in Gogri P.S. Case No. 171 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
