The petitioners are apprehending their arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 406 and 417 of the Indian Penal Code. It is alleged that the petitioners being the Director and the employee of the Alokik Direct Marketing Private Limited, a non-banking company, persuaded the complainant to become an collecting agent and consequently the complainant collected Rs. 9,000,00/- and deposit the same in
Patna High Court Cr.Misc. No.30778 of 2014 (4) dt.02-04-2015 the financial company, but subsequently some cheque was issued by the company which got bounced.
It is submitted by the learned counsel for the petitioners that the collection was made by the complainant and no investor has made any complaint. The complainant who actually collected money filed the present complaint to save his own skin.
It is submitted by the learned counsel for the complainant that the complainant along with several investors has been cheated and other cases have also been lodged against the petitioners with similar allegation. Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Complaint Case No. 3084 of 2012, pending in the court of learned Judicial Magistrate, Ist Class, Chapra.
With this observation this application is disposed of.
