This is an appeal under Sections 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, against refusal of the prayer for anticipatory bail by order dated 16.04.2018 by the learned Additional District and Sessions Judge-1st Jamui in connection with Jamui P.S.Case No.
of registered under Sections 302,341,120(B) of the Indian Penal Code, Section 27 of Arms Act and later on Sections 3(1)r/3(ii) of the Scheduled Castes and Scheduled Tribes Act has been added.
According to FIR, the appellant is assailant of Binay Paswan by causing firearm injury. Informant is eye witness of the occurrence. Witness-Shrawan Paswan has also supported
Patna High Court CR. APP (SJ) No.1642 of 2018 dt.17-07-2018 2/2 the allegation before the police as eye witness. Learned counsel for the appellant submits that one of the injured has been examined by the police and he has not stated that the appellant was the main assailant. Considering the aforesaid material, I am not inclined to enlarge the appellant on anticipatory bail. Accordingly, this appeal stands dismissed.
