JUSTICE SANJAY PRIYA ORAL ORDER 5/ 04-07-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends her arrest in East Colony P.S. Case No.15 of 2018 instituted for the offence under Section(s) 120-B, 114, 302, 307/34 Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is a lady. She is Chairman of Jamlapur Nagar Parishad. In the written report, it is alleged that on the order of this petitioner and Sunil Vishwakarma, ten persons, as named in the written report, fired on account of which Nandan Kumar and Rakesh Kumar died.

Patna High Court Cr.Misc. No.27834 of 2018 (5) dt.04-07-2018 2/3 Superintendent of Police, in his supervision note has found the case true against the petitioner, but the Superintendent of Police in his supervision note has not found the case true against the petitioner.

In the written report, there is no specific allegation against this petitioner of causing injury to the deceased. It is merely alleged that the petitioner was order giver. In the facts and circumstances of the case, prayer of the petitioner for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with East Colony P.S. Case No.15 of 2018, she shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Jeevan Lal, Additional Chief Judicial Magistrate, Munger, subject to the conditions as laid down under Section 438(2) Cr. P. C.

Patna High Court Cr.Misc. No.27834 of 2018 (5) dt.04-07-2018 3/3 with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
