Petitioners apprehend arrest in connection with Desari P.S. Case No. 218 of 2013 registered under Sections307, 498A, 302/34 of the Indian Penal Code. Allegation against the petitioners is of torture and cruelty due to non-fulfillment of demand of dowry. Earlier, a written complaint was submitted before Mahila Ayog with regard to cruelty wherein the accused gave undertaking that he will keep his wife happily and will lead peaceful conjugal life, but later on petitioners are alleged to have set the deceased on

Patna High Court Cr.Misc. No.32078 of 2015 (9) dt.09-02-2017 2/2 fire.

Learned counsel for the petitioners submits that the deceased died in an accident in kitchen due to leakage in gas pipe. The deceased also while being treated at Gokul Hospital, Kankarbagh, Patna gave her fardbeyan that she got burnt due to leakage in gas pipe. Doctor has also stated that when the deceased gave her statement she was in semi conscious position and could have very well given her statement. Considering the facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishlai at Hajipur in connection with Desari P.S. Case No. 218 of 2013 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
