Heard learned counsel for the petitioner; learned APP for the State as well as learned counsel for the opposite party no.2.

The petitioner apprehends his arrest in connection with Complaint Case No.3200C/2018 for offences under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

It has been jointly submitted by the parties that they have entered into one time settlement and a copy of the settlement deed dated 31st of January, 2022 has been annexed as Annexure-4 with the supplementary affidavit filed by the

Patna High Court CR. MISC. No.54006 of 2019(8) dt.07-02-2022 2/2 petitioner.

In view of the terms of the compromise particularly paragraphs 3 and 4 of the compromise deed dated 31st of January, 2022, this application for anticipatory bail is allowed. Accordingly, let petitioner, above-named, in the event of his arrest or surrender within ten weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna in connection with Complaint Case No.3200C/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. It is expected that both the parties will abide by the terms of the compromise deed dated 31st of January, 2022 and they will not violate the terms thereof.

The Principal Judge, Family Court, Patna will also dispose of Maintenance Case No. 355(M) of 2018 in the light of the compromise deed dated 31st of January, 2022. Withe aforesaid observation and direction, this application is allowed.
