JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Kharik P.S. Case No. 99/2019, disclosing offences under Sections 147, 148, 149, 341, 323, 447, 307, 324, 325, 379, 504, 506 of the Indian Penal Code.

Allegation against two co-accused persons that they assaulted the informant by means of axe and dabiya and, thereafter, there is allegation against these petitioners of assaulting the family members of the informant. Submission of learned counsel for the petitioners is that there is case and counter case and title suit is going on

Patna High Court CR. MISC. No.60725 of 2019(2) dt.25-09-2019 2/2 between the parties and further no specific allegation has been attributed to the petitioners.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Naugachia (Bhagalpur) in connection with Kharik P.S. Case No. 99/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
