Mr. Upendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-09-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 307, 147, 379, 504 and 506 of the Indian Penal Code.

3. The prosecution case, in brief, is that on 28.06.2022, all the F.I.R. named accused persons, including these petitioners, came to the house of informant and started abusing her and upon protest, Petitioner No. 1 tied a rope around her neck and tried to kill her by strangulation. It is further alleged that thereafter, all the accused persons brutally

Patna High Court CR. MISC. No.58633 of 2025(2) dt.23-09-2025 2/3 assaulted her by means of iron rod and lathi and co-accused Anmol Singh snatched Rs. 600/-.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. From bare perusal of the F.I.R. it is apparent that allegation of assault is general and omnibus. As a matter of fact, both parties are Pataidars and due to admitted civil dispute between the parties, this false and concocted case has been lodged. It is further submitted that similarly situated co-accused persons have already been granted bail by the learned trial court. It is lastly submitted that during pendency of this case, with the help of intervention of well wishers of both the parties, the matter has already been compromised and a joint compromise petition to this effect, duly signed by both the parties, has also been filed, copy of which is Annexure-P/2 to this petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the facts and circumstances of the case and compromise between the parties, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st (West), Muzaffarpur in connection with Paroo P.S. Case No. 336 of 2022, subject to condition as laid down under Section 482(2) of the B.N.S.S..
