JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 02-05-2018 Petitioner has filed this petition for extension of the period for payment of Rs. 1,75,000/- to the informant by making necessary modification in the order dated 17.10.2017 passed by this Court with the case that while allowing the bail petition of the petitioner vide aforesaid order, he was directed to pay Rs. 1,75,000/- to the informant within four months in two equal installments of two months each and in default of payment of the aforesaid money within the stipulated period, the informant may move before the learned lower court for cancellation of his bail bonds.
But as the auction notice has been issued by the Bank of India under the SARFAESI Act, 2002 regarding property of the petitioner, no one is ready to purchase the property of the
Patna High Court Cr.Misc. No.16492 of 2018 (4) dt.02-05-2018 2/2 petitioner despite his best efforts. He also tried to take loan from his well wishers and relatives but the said notice marred his effort. However, to manage the money by selling land/property in his village, he has requested further four months time for the payment of the aforesaid money to the informant by way of last indulgence. He has also submitted that his bail bond has not been cancelled by the learned lower court.
In the aforesaid facts and in the interest of justice, period for payment of the aforesaid money to the informant is hereby extended for four months by way of last indulgence, if the bail bond of the petitioner has not been canceled by the learned lower court.
Accordingly, order dated 17.10.2017 is modified to the aforesaid extent.
