====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 11-09-2024 Heard learned Counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending arrest in connection with Brahampura P.S. Case No. 84 of 2024 registered on 02.04.2024 for the offences punishable under Sections 498A, 494, 302/34 of the Indian Penal Code.
3. As per the prosecution, the FIR has been lodged against the petitioners and others against whom the allegation has been made that brother-in-law of the informant, his mother and his younger brother used to torture the sister of the informant. They also demanded money, upon oppose they used to assault the deceased.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel
Patna High Court CR. MISC. No.61557 of 2024(2) dt.11-09-2024 2/2 submits that petitioner No. 1 is the mother-in-law and petitioner No. 2 is devar of the deceased. Counsel submits that the health of the deceased was not good, she used to live in frustration due to not having children from the conjugal life. Counsel submits that the petitioners are residing at a different place while the deceased was living with her husband separately. Counsel submits that the husband of the deceased has already been arrested and he is in custody. Counsel also submits that antecedent of the petitioners are clean.
6. Learned APP for the State opposes the prayer for bail.
7. In the present facts and circumstances, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate (F.C.), Muzzaffarpur in connection with Brahampura P.S. Case No. 84 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
