JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 21.06.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Begusarai Town P. S. case no. 615/2017 registered under section 379 of the IPC.

Admittedly, FIR was lodged on 3.11.2017 against unknown persons. The name of the petitioner came in this case in course of investigation when one co-accused Amit Kumar was arrested and made his confessional statement. Submission on behalf of the petitioner is that the petitioner has become prey of atrocity of the police and, as a matter of fact, motorcycle bearing registration no. BR-09 - 3784 of the petitioner was seized by the police in the name

Patna High Court Cr.Misc. No.28035 of 2018 (3) dt.21-06-2018 of checking of the documents and when the petitioner showed documents of his motorcycle and prayed for release of his motorcycle, the concerned police official refused to release motorcycle and thereafter, petitioner filed a petition before C.J.M which caused annoyance to the police official as a result whereof the petitioner was implicated in the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the fact that the petitioner does not have any criminal antecedent, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Begusarai in Begusarai Town P. S. case no. 615/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
