JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2018 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Sahiyara Police Station Case No. 124 of 2017, disclosing offences under Sections 341, 323, 324, 379, 504, 307, 506 and 34 of the Indian Penal Code.

Allegation against the petitioners is that petitioner no. 1 ordered petitioner no. 2 to assault the informant, on which petitioner no. 2 gave knife blow to the informant. F.I.R further shows that the informant is a press reporter and he had come to capture the irregularity being done in the school. Learned Counsel for the petitioners has submitted

No.19051 of 2018 (3) dt.03-05-2018 2/3 out and out false and fabricated allegations have been made and it is the informant, who had come make illegal demand and when the students protested, in which he received some injuries. Having heard both sides, considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -V, Sitamarhi, in connection with Sahiyara Police Station Case No. 124 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure., it is further subject to the condition that:- I.

One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.

The petitioners shall cooperate in the investigation and make themselves available as and when required by the police and on the event on failure of their part to appear before the police on two consecutive dates, the
