The petitioner apprehends his arrest in Nardiganj P.S. case No. 239 of 2018 registered under Section 147, 148, 149, 323, 308, 379, 504, 506 of the IPC and u/s 27 of Arms Act. The informant named the petitioner along with other accused persons and alleged that they all, having armed with different weapons, came. Ramdeo Yadav assaulted Bachchu Yadav, father of the informant, with Garasa on his head with an intention to kill him. Raushan Yadav and Bali Yadav assaulted the informant with iron rod.

The learned counsel for the petitioner submits that there is counter version and the occurrence took place due to land dispute. The accused persons in the counter case have already been granted anticipatory bail but it appears that

Patna High Court CR. MISC. No.55716 of 2019(2) dt.05-09-2019 2/2 petitioner is alleged to have assaulted the father of informant with Garasa and other accused persons indiscriminately assaulted him. From perusal of injury report of Bachchu Yadav, father of the informant, it appears that he got as many as seven injuries on different parts of his body and the injuries are also opined to be grievous in nature.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
