The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Basantpur P.S. Case no. 288 of 2021 instituted for the offence under Sections 362, 366, and 34 of the Indian Penal Code.

Prosecution case relates to abduction of daughter-inlaw aged 25 years, grandson and bhagini, aged about 22 years of the informant. Informant had a strong suspicion that co-villager Atul Kumar, after alluring them, taken away for purpose of marriage.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.68497 of 2021(2) dt.18-07-2022 2/2 has submitted that petitioner is innocent and has committed no offence. It is highly improbable that a man can kidnap two ladies at a time by train to Surat. Petitioner is a student. He has got no criminal antecedent.

Learned counsel for the informant and learned APP appearing for the State have opposed the prayer of bail and submitted that after recovery of the victim ladies, their statements were got recorded under Section 164 Cr.P.C. in which both have specifically stated that petitioner has kidnapped them after making them un-conscious by putting a piece of intoxicated cloth at their face and locked them in a room. Having heard learned counsel for the parties and taking into consideration that there is directed allegation of kidnapping against the petitioner, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected.
