The petitioner has filed the instant application for grant of regular bail in connection with Dhansoi P.S. Case No. 101 of 2022 registered under Sections 392 of the Indian Penal Code and later Section 395 and 412 of the I.P.C. was added. Prosecution case in short is that the informant is worker of one Fusion Micro Finance Ltd, and on the date of occurrence he collected Rs. 1,21,180/- from different village centre and thereafter in the way of returning, three miscreants on pistol point looted away the bag containing above said amount along with his mobile. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. He has no concern with the other co-accused. The petitioner is not named in F.I.R.
Patna High Court CR. MISC. No.58208 of 2022(3) dt.09-02-2023 2/2 rather his name transpired in this case only on the basis of confessional statement of other co-accused Vikash Kumar, which has got no evidentiary value in the eye of law. Neither anything incriminating article has been recovered from the possession of the petitioner nor he has been put on T.I.P. Similarly situated other coaccused persons have already been granted bail by this co-ordinate Bench of this Court vide order dated 30.11.2022. in Cr. Misc. No. 58034 of 2022. The petitioner is languishing in judicial custody since 15.07.2022.
The application for bail is vehemently opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Dhansoi P.S. Case No. 101 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-Vth, Buxar. (Sunil Kumar Panwar, J) shubham/- U T
