JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-09-2023 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State. The petitioners have prayed for bail in a case instituted for the offence under Sections 307, 302, 120-B/34 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation in the FIR, co-accused Raushan Kumar, Rakesh Kumar, Ravindra Kumar and Rahul Kumar in connivance with other accused persons have killed the informant's husband by opening fire. His dead body was lying in North from road sustaining two fire arms shot on head and two fire arm injuries at chest apart from broken legs and hand.

Patna High Court CR. MISC. No.59706 of 2023(2) dt.08-09-2023 2/2 It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. Informant is not a eye witness . No overt act or any active role has been levelled in the entire FIR. Both parties are co-villagers and having land dispute. No specific allegation of firing is against the petitioners. Petitioners are in custody since 24.6.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned ACJM-1st Class, Gaya in connection with Wazirganj P.S. Case No. 375 of 2023.
