JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Petitioners are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 406, 420 of the Indian Penal Code.
It is alleged that complainant gave Rs.
63,000/- and complainant's witnesses Ajay Shankar gave Rs. 78,000/- to the petitioners on assurance to provide employment abroad.
It is submitted by learned counsel for the petitioners that no time, place, date or the mode of payment has been mentioned in the complaint. For the occurrence of June, 2014 the complaint has been filed on 24.11.2014. It is further submitted that petitioners are co-villagers of the complainant and due to the petty dispute the accusation has been levelled. Petitioner Nos. 2 and 3 are sons of petitioner No. 1.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Complaint Case No. 1538(C) of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
