JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-11-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Habibpur P.S. Case No. 70 of 2016, registered under Sections 341, 323, 324, 325 and 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of torturing the daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that admittedly, petitioner is the husband of the daughter of informant and the present case has been lodged with ulterior motive, in fact, on the date of occurrence, petitioner was assaulted by the

Patna High Court Cr.Misc. No.15874 of 2017 (3) dt.02-11-2017 informant and other family members, in which, petitioner sustained injury and admitted in the hospital, regarding which, Habibpur P.S. Case No. 72 of 2016 is also instituted on the basis of written report of the petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Habibpur P.S. Case No. 70 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
