2. Petitioner seeks regular bail in a case registered for the offence punishable under Section 103, 61(2) and 3(5) of the BNS and Section 27 of the Arms Act.
3. As per the prosecution case, husband of the informant was shot dead by four unknown miscreants.
4. Learned counsel for the petitioner submits that petitioner is not named in the FIR. Name of the petitioner transpired during course of investigation in the confessional statement of co-accused Bhogal Mukhiya and Chandan Paswan. There is no substantive material to show the active participation of the petitioner in the alleged occurrence. Similarly situated other co-accused person Ramashish Kumar @ Ramashish Paswan has already been granted regular bail by a co-ordinate
Patna High Court CR. MISC. No.56043 of 2025(3) dt.20-11-2025 2/2 Bench of this Court vide order dated 11.09.2025 passed in Cr. Misc. No. 46242 of 2025. Petitioner is in custody since 30.04.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, West Champaran, Bettiah in connection with Shikarpur P. S. Case No. 207 of 2025.
