Heard the learned counsel for the parties.

At the outset, learned counsel for the petitioner has submitted that one Title Suit No. 952 of 1996 with regard to the same issue is pending in the Court of Munsif, Araria. 3.

The Munsif, Araria is directed to dispose of the Title suit pending before him within six months from the date of receipt/communication of a copy of this order. 4.

The petitioner may also file an injunction petition in the court of the Munsif.

If such an injunction petition is filed, the same shall be considered and decided within one month of filing of the injunction petition by the Munsif, Araria.

The Railways and other private respondents, if any, shall cooperate in disposal of the title suit.

The Munsif will proceed ex-parte against the noncooperating party and conclude the proceeding within the time fixed by this Court as mentioned above.
