ANJANA MISHRA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner and learned counsel for the Bihar State Food and Civil Supplies Corporation as well as learned counsel for the State.

The petitioner apprehends her arrest in connection with a case registered for the offences punishable under Section 409/420/427 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is posted as an Executive Assistant under the Block Agriculture Officer and she is required to assist him at the purchase centre. She is neither In-charge of any paddy.

Learned counsel for the Bihar State Food and Civil Supplies Corporation, however, submits that in other similar cases where

No.33210 of 2015 (2) dt.13-08-2015 P2/2 the officers faced prosecution, they have deposited certain percentage of the amount alleged to have been defalcated in the present context also. The petitioner has deposited thirty thousand. Be that as it may, let the petitioner deposit a further amount of rupees one lac within a period of six weeks from today. Subject to the condition, let the petitioner Shilpa, in the event of her arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 190/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
