The petitioner seeks regular bail in Shahpur P.S. Case No. 96 of 2008 registered for the offence under Sections 447, 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that Kundan Yadav fired, which hit on his back. The petitioner Haresh Mishra assaulted him with Sawal on his head and left hand. Sheo Muni Mishra and others also assaulted him.

It appears that four injuries were found on the body of

Patna High Court Cr.Misc. No.31192 of 2014 (3) dt.12-01-2015 2/2 the informant, out of which, one injury, found on the left hand, is grievous in nature. Kundan Yadav, who has alleged to have fired on the back of the informant, has already been enlarged on bail vide order dated 21.11.2008 passed in Cr. Misc. No. 26546 of 2009. The petitioner is in jail custody since 06.11.2013 and other accused persons have also been enlarged on bail. Considering the facts aforesaid and the nature of allegation, made against the petitioner and the petitioner is in custody since 06.11.2013, petitioner, named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 3rd Adhoc Additional Sessions Judge, Bhojpur at Arrah in connection with S.Tr. No. 102 of 2014 arising out of Shahpur P.S. Case No. 96 of 2008.
