The petitioner apprehends his arrest in Bihariganj P. S. Case No. 171 of 2016 registered for the offences under Sections 147,, 148, 149, 156, 295A, 341, 323, 353, 332, 333 and 427 of the Indian Penal Code.
500 persons including the petitioner are said to have made uproar during the cultural programme, pelted stones and damaged vehicles of the government officials. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. He has been falsely implicated in the case. He happens to be the member of the mob. There is no specific allegation levelled
Patna High Court Cr.Misc. No.18273 of 2017 (2) dt.14-06-2017 2/2 against the petitioner rather it is general an omnibus in nature. Several co-accused have been enlarged on bail by this court vide order dated 13.02.2017 passed in Cr. Misc. No. 6892 of 2017. The case of the petitioner stands on similar footing. Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Udakishunganj, Madhepura in Bihariganj P. S. Case No. 171 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
