The petitioner is apprehending his arrest in connection with Chakia P.S.Case nO.177 of 2017 , registered for offences punishable under Sections 406 and 409 of the Indian Penal Code. Petitioner is running the Customer Service Centre and there is allegation that he defalcated about Rs.05 lac. Submission of the learned counsel for the petitioner is that the allegation is vague in nature and it is not possible for the petitioner to defalcate the money and allegation of defalcation of amount is false, which will appear from the fact that recently the licence was renewed.

Heard learned A.P.P. also.

No.22772 of 2018 (3) dt.22-06-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender within a period of ten weeks from the date of receipt of the order and deposit 50 % of the alleged defalcated amount, which will be subject to result of the case and if such amount is deposited, he will be released on bail on bail bond of Rs.25,000/- in connection with Chakia P.S.Case No.177 of 2017 dated 29.6.2017 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that one of the bailor shall be local one and in the meantime, for ten weeks no coercive step shall be taken against the petitioner.
