JUSTICE ARUN KUMAR ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner apprehends his arrest in connection with Complaint Case No. 3332 of 2014, T.R. No. 1597 of 2016 lodged for the alleged offences under Sections 420, 468, 120B of the Indian Penal Code.

Allegation in brief is that the accused Hari Narayan Chaudhary came at the shop of the complainant for sale of the land. Hari Narayan Chaudhary claimed to have Power of Attorney in respect of piece of land and complainant paid money thereafter sale deed was executed in which the petitioner is one of the witnesses of the sale deed. Later on complainant came to know

Patna High Court Cr.Misc. No.14656 of 2017 (3) dt.14-06-2017 2/2 that out of purchased land, approximately 4 katha and 10 Dhur of the land was purchased by Hari Narayan Chaudhary and some other also purchased the rest land and they have sold the land to others so cheated the complainant.

Learned counsel appearing on behalf of petitioner submits that the petitioner is only witness of the sale deed neither received the consideration money nor executed the sale deed. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IX, Gopalganj in connection with Complaint Case No. 3332 of 2014 (Trial No. 1597/16).
