JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 78 of 2019 registered for the offences punishable under Sections 467, 468, 414 of the Indian Penal Code and Sections 30(a), 30(b) and 30(c) of Bihar Prohibition and Excise Act.

Police on information of manufacturing of liquor raided the bank of canal and accused persons succeeded in fleeing away but three persons have been apprehended, who have named the petitioner and others, who succeeded in fleeing away and from the apprehended persons total 45 litres of liquor were recovered and some other articles were also recovered from the place of occurrence.

Submission of learned counsel for the petitioner is

Patna High Court CR. MISC. No.53948 of 2019(2) dt.28-08-2019 2/2 that he has been made accused only on the basis of confessional statement made by co-accused and nothing has been recovered from his conscious possession and land does not belong to the petitioner and petitioner has no criminal antecedent. Heard learned APP, who could not controvert the above fact.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, West Champaran, Bettiah, in connection with Chanpatiya (Sirisiya O.P.) P.S. Case No. 78 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
