1. Heard learned counsel for the petitioners and learned APP for the State.
2. The learned counsel for the petitioners, after some argument, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1, Shankar Das.
3. Permission is accorded.
4. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.1, Shankar Das.
5. The petitioner no.2 seek bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2),115(2),117(2),109,303(2),352,351(2),3(5) of the B.N.S.

The learned counsel for the petitioner submits that the petitioner no.2 is a person with clean antecedent and the informant alleges that he was intercepted by the accused persons including the petitioner in the market and Shankar Das assaulted him by an iron rod causing injury on head and repeated the blow fracturing his finger and Chandra Kishore Das assaulted Bittu with iron rod causing injury on head and repeated the blow injuring his palm also and Shankar snatched chain of Bittu worth Rs. One Lac.
7. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that since petitioner is a friend of Shankar Das, as such, he came to be implicated. It is also submitted that even injury suffered by Bittu is simple in nature.
8. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner no.2, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of
Patna High Court CR. MISC. No.58807 of 2025(2) dt.09-09-2025 3/3 the like amount each to the satisfaction of the learned J.M. 1st Class, Motihari, East Champaran in connection with Rajepur P. S. Case No.116 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
