JUSTICE ARUN KUMAR ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Mehndiganj P.S. Case No.67 of 2016, registered under Sections 363, 366 and 365 of the Indian Penal Code.

Allegation in brief is that the informant's wife was kidnapped by the petitioner.

Learned counsel for the petitioner submits that the wife of the informant was a consenting party and she eloped with the petitioner. Her statement, given under Section 164 Cr.P.C. that petitioner had taken her jewellery and other items is false. The learned APP submits that the victim lady was recovered and her statement was recorded under Section 164 Cr.P.C. and she has supported the allegation.
