The petitioners apprehend their arrest in Rajgir P.S. Case No. 105/2017, registered for the offences punishable under Section 366 of the Indian Penal Code.

The informant alleged that Santosh Chaudhary and his friends kidnapped her daughter and when the informant went to enquire at the house of Santosh Chaudhary, the petitioners are alleged to have abused and assaulted the informant. Learned counsel for the petitioners submits that from perusal of the F.I.R. itself, it appears that the petitioners are father, mother of Santosh Chaudhary. It is further submitted that the

Patna High Court Cr.Misc. No.29185 of 2017 (3) dt.19-08-2017 2/2 victim is a married woman. There is no material to show that the petitioners and their son are involved in kidnapping of the victim. Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Biharsharif, Nalanda in connection with Rajgir P.S. Case No. 105/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
