JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 15-06-2017 Heard learned counsel for the petitioners as well as learned APP for the State.
The petitioners apprehend their arrest in Gaunaha P. S. Case No. 110 of 2016 registered for the offences under Sections 147, 148, 149, 323, 324, 307, 380, 436 and 504 of the Indian Penal Code.
Petitioners are said to have torched the house of Sk. Aslam, assaulted the informant and Sazaul Sah and also looted the house of Samsul Dewan and Sk. Ijhar over the row of
Patna High Court Cr.Misc. No.18117 of 2017 (3) dt.15-06-2017 2/2 collision of cycle of boys of two communities. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and they have committed no offence and they have been falsely implicated in the case. The allegation levelled against the petitioners are not specific rather general and omnibus in nature. There is a case and counter case between the parties. The injuries sustained by the victims are simple in nature.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in Gaunaha P. S. Case No. 110 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
