2. The petitioner has preferred this application for grant of regular bail in connection with Sheikhpura P.S. Case No. 239 of 2024 dated 31.05.2024 registered for the offence/s punishable u/ss 379, 406, 409, 420, 201, 120B read with section 34 of the Indian Penal Code.
3. As per the prosecution case, the allegation against the petitioner and the co-accused person is of committing theft and misappropriating gold worth Rs. 1.52 crore which was deposited in the bank.
4. Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.60736 of 2024(4) dt.18-10-2024 2/3 the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner. The petitioner is employed as a cashier in the said branch and he was not present in the said bank on the alleged date of occurrence. It is further submitted that on the basis of the confessional statement of one Sunil Kumar, police recovered stolen gold from the house of the co-accused Ranjit Yadav and Kundan Chouhan. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 01.06.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheikhpura in connection with Sheikhpura Town P.S. Case No. 239 of 2024, with the following condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
